Exclusive possession of the home
Provincial and territorial legislation allows the court to give one of the two partners the sole right to occupy the family home and to prohibit the other from coming onto the property. These orders are most commonly made where there has been a history of family violence.
Protection/restraining orders
Protection/restraining orders, which keep one partner away from the other, are also governed by provincial/territorial legislation and differ from one part of the country to another.
For safety-related orders, the survivor will need to provide evidence of abuse.
