What is an affidavit?

An affidavit is a legal document that a person swears or affirms is the truth, in writing and in front of a witness. It is a chance for each person to tell their story to the court and is a key piece of the evidence that the judge will rely on.

How should an affidavit be written?

How an affidavit must be written:

  • It should be clearly written, in logical order as one would tell a story and be detailed and precise.
  • It should be written in a formal tone.
  • Paragraphs should be numbered.
  • It is written in the first person and makes use of the word “I” to refer to the person who is writing, as though the woman is talking directly to the court.

What should an affidavit say?

It should answer key questions such as:

  • Who is my family?
  • What do I want?
  • Why should I get it?

If a woman does not have a lawyer, your role will be to support her to write the affidavit. Use our sample as a guide.
