Divorce

Only the federal Divorce Act can grant a divorce.

People can seek a divorce once they have been separated (even if they have remained living under the same roof) for at least one year or, in some cases, if there has been adultery or extreme cruelty.

People can obtain a Canadian divorce regardless of where they married, as long as their marriage was legal where it took place. Anyone starting a divorce application must have lived for at least one year in the province or territory where they are filing the application.
